Acceptance of Terms

IN NO EVENT SHALL PHL178'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO PHL178 IN THE SIX (6) MONTHS PRECEDING THE DATE OF THE CLAIM, OR ONE THOUSAND PESOS (₱1,000.00), WHICHEVER IS LESS.

Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of phl178 Services shall first be attempted to be resolved through good-faith negotiations between you and phl178. If the dispute cannot be resolved through negotiation within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. The arbitration shall be conducted in English in Metro Manila, Philippines. The decision of the arbitrator shall be final and binding upon both parties.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

General Provisions

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Metro Manila, Philippines for the resolution of any disputes.

14.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

14.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account to any third party without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Entire Agreement

These Terms, together with our Privacy Policy and Responsible Gaming Policy, constitute the entire agreement between you and phl178 regarding the use of our Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
